PREAMBLE These General Terms and Conditions of Use of the Eventim Light Service (hereinafter referred to as the "GTCU") govern the relationships between an event organizer, a natural or legal person using the Eventim Light Service to market its Tickets (hereinafter referred to as the "Organizer"), a major natural person purchasing a Ticket for non-professional purposes (hereinafter referred to as the "Client") and the agent France Billet. The Organizer may enter into special conditions in addition to these. France Billet, a simplified joint-stock company, with a capital of €352,512, registered in the Créteil Trade and Companies Register under number 414 948 695, domiciled at Zac du Port d'Ivry 9 rue des Bateaux Lavoirs 94200 Ivry sur Seine, provides a matchmaking service between Organizers and Clients for the purchase of Tickets (the "Eventim Light Service"). France Billet is an intermediary agent of the Organizer acting under a transparent agency contract which gives it the power to issue, manufacture, sell, and market the Organizer's tickets in the name and on behalf of the Organizer of events. PREAMBLE These GTCU only concern the matchmaking service between Organizers and Clients for the purchase of Tickets and not the show or event itself. Certain activities offered, particularly sports activities, may also include additional conditions or internal regulations specific to the Organizer or the site concerned and available from said site and/or said Organizer. The GTCU are available for information in English or other languages, in case of interpretation discrepancies between these documents, the French text prevails over the other versions. ARTICLE 1 – OPERATION OF THE EVENTIM LIGHT SERVICE 1.1 Operation for the Organizer Account Creation The Organizer creates an account to offer its events through a dedicated ticketing site. The Organizer provides the information requested by France Billet and accepts these GTCU. The Organizer's account is personal and confidential, and the Organizer agrees to keep its access codes and identifiers confidential. The Organizer guarantees France Billet compliance with its legal and regulatory obligations and agrees to justify all its declarations to France Billet upon first request. The Organizer also agrees to maintain all necessary insurance policies in force to cover its liability in all cases where it could be engaged, particularly to cover its liability related to the organization of the event posted online via the Eventim Light Service and in case of event cancellation, for sufficient amounts, and for all types of damage (bodily and material, consequential and non-consequential immaterial) caused by it, its staff, its collaborators, or the goods used, to third parties, Clients, France Billet or its staff. Furthermore, the Organizer is responsible for the event's compliance with the laws in force, the Clients' safety, and the proper conduct of the event according to the description provided to its Clients. Event Creation The Organizer creates the events and integrates all necessary and essential elements for their identification and agrees to offer the most reliable description to the Client. The Organizer agrees that Clients have complete information on the access and event procedures. The Organizer agrees that the content published through the Eventim Light Service is in no way insulting, defamatory, denigrating, slanderous, contrary to good morals, counterfeit; does not infringe public order or third-party rights or incite hatred or violence in any way. Any failure by the Organizer may result in the deletion of the event or the closure of the Organizer's account permanently or temporarily. 1.2 Operation for the Client Order The Client creates an account to order Tickets from the Organizer via France Billet and accepts these GTCU. Price and Number of Seats The ticket prices (face value) are indicated in euros, including all taxes, excluding additional cancellation insurance fees, e-ticket fees, and/or transaction fees paid by the Client in exchange for the service provided by France Billet. These fees cover the technical and maintenance costs of the Eventim Light Service, banking fees, and/or customer service. The transaction fees per order are clearly indicated before purchase confirmation. The transaction fee amount varies according to the total order amount. The total number of seats in cumulative reservations per person cannot exceed the number of seats defined by the Organizer across all categories (20 unless otherwise indicated). The same person cannot make multiple orders spaced over time to bypass this rule, with one or more bank cards. Different types of rates may be offered depending on the events. Regarding group rates, when offered, a minimum number of seats is required (usually between 15 and 20, unless exceptions). In case of non-compliance with these rules, the Organizer reserves the right to cancel the order(s). Show tickets remain the property of the Organizer until the full and final payment of the price by the Organizer through France Billet, in the name and on behalf of the Organizer. 1.3 Commitment of France Billet France Billet commits to providing users and Clients with the Eventim Light Service as a transparent agent for the Organizers. Any complaint or request for assistance concerning the accessibility of the Eventim Light Service will be handled by France Billet’s Customer Service. ARTICLE 2 – AVAILABILITY OF TICKETS Ticket reservations are made in real-time. In this context, the server informs the Client in real-time about the availability of Tickets at the time of order placement. In case of unavailability in one of the requested seat types, the server automatically proposes the best remaining seats. In the cart, the Client can check that the allocated seats match the Client’s wish. Indeed, if the number of desired seats exceeds the remaining seats in the chosen category, it may be that, considering the number of requested seats, the Client is allocated seats spread between the chosen category and other categories, or the allocated seats are not side by side. If these seats do not suit, the Client can cancel them on the "My Cart" page by clicking on the corresponding "Cancel" icon. ARTICLE 3 - SEATING PLANS AND SEAT LOCATION Depending on the hall’s configuration and the event, the following seats may be offered: Numbered seats, seats in several categories each corresponding to different areas of the hall, which may or may not be numbered, free seating throughout the hall. Seats may be indicated on a seating plan if available. The location on this plan is provided as representatively as possible. However, depending on the actual size of the hall depicted on the plan, the location may indicate either the precise seat or a zone within the hall where the seats are located. ARTICLE 4 – PAYMENT By clicking "Validate my cart," the Client acknowledges that their order implies an obligation to pay the indicated price. Payment for purchases can be made according to the accepted payment methods offered at the time of purchase. Once the purchase is made from the Organizer, France Billet on behalf of the organizer, sends the Client the payment receipt, the Ticket in PDF format, and a link to access the digital version of the Ticket by email. France Billet does not issue physical Tickets. France Billet collects, on behalf of and for the account of the Organizer, the price of the Tickets. ARTICLE 5 - SECURING PAYMENTS AND PERSONAL DATA 5.1 Securing Payments The payment is subject to a security system with payment authorization by the Client's bank. In the context of anti-fraud measures, 3D Secure payment, an authentication payment system, is implemented. This service is free and can be triggered for payments by Carte Bleue, Visa, and MasterCard. With 3D Secure (or Verified by Visa or MasterCard SecureCode), the Client's bank verifies the Client’s identity at the time of payment. The identification process is specific to each bank, and the Client must check with their bank the authentication process used. 5.2 Personal Data The Organizer configures the event uploaded through the Eventim Light Service. The Organizer decides on the personal data needed for ticket provision; only this data will then be processed. For certain processing, France Billet is the data controller, and these processes are detailed in the privacy policy. In accordance with current personal data protection regulations, you can exercise your rights regarding the Eventim Light Service (access, rectification, deletion, opposition, limitation, and portability where applicable) and define the fate of your personal data "post mortem." For other processing, the Organizer is the data controller. To learn more about them, the Client can refer to the Organizer's privacy policy available on the Organizer's page. ARTICLE 6 – ORDER CONFIRMATION Your Ticket order is definitively confirmed and binds the Organizer only upon receipt of the email confirming that the order has been validated. Therefore, we invite you to check your email and verify the provided email address. ARTICLE 7 - VALIDATION You declare that you have read and accepted the GTCU before placing your order. The validation of your order constitutes acceptance of these GTCU. ARTICLE 8 - OBTAINING TICKETS The receipt of an e-Ticket in your "My Account" section and by email. The payment receipt and tickets are sent to the shipping address you provided during the ordering process (home address or another address). Specific conditions for the e-Ticket: unless otherwise informed, the Client must print their e-Ticket at home on a regular printer. To be valid, your ticket must be printed in portrait mode on a blank A4 white sheet, blank on both sides. Each purchased place corresponds to a ticket. The e-Tickets have a unique barcode. The validity of the tickets is checked and recorded at the entrance with barcode readers. It is impossible to be admitted multiple times with the same ticket. Ticket reproduction is prohibited and will not provide any advantage. Only the first person presenting the ticket will be admitted to the event. They are presumed to be the legitimate ticket holder. Therefore, it is forbidden to reproduce, duplicate, counterfeit the ticket in any way, or make it available for such purposes. Keep your ticket in a safe place. Use exclusively an official sales circuit to buy your ticket. Never accept a ticket offered by a stranger, as it may be a copy. The Organizer may refuse entry to the event when multiple prints, reproductions, copies, or imitations of an e-Ticket are in circulation, and access to the event has already been granted to the holder of a print, reproduction, copy, or imitation of the corresponding e-Ticket. The Organizer is not required to verify the identity of the person presenting the e-Ticket to check that it is indeed the ticket buyer, nor to verify the authenticity of the e-Ticket to the extent that the imitation or copy cannot be undoubtedly identified as such during the entry control to the event. If the holder of an e-Ticket is turned away for this reason during an access control, there is no right to a refund of the paid price. The Client takes all necessary precautions to keep their password secret and to prevent any use by unauthorized persons or any breach. France Billet disclaims all responsibility: for anomalies that may occur during the order, processing, or printing of the e-Ticket, to the extent that it did not intentionally cause them or through negligence in case of loss, theft, or illegal use of the e-Ticket. No duplicate or certificate, remission of the ticket, of any kind, other than the initial ticket printable by the Client, will be issued to the Client. The right to a refund belongs exclusively to the initial ticket buyer and is not transferable. ARTICLE 9 - CANCELLATION, POSTPONEMENT, REFUND, USE 9.1 No Right of Withdrawal In accordance with Article L 221-28 of the Consumer Code, show Tickets are not subject to a right of withdrawal. A show ticket cannot be refunded even in case of loss or theft, nor exchanged, except in case of cancellation or postponement of a show. 9.2 Cancellation or Postponement In case of cancellation or postponement of the show, only the ticket price will be refunded (excluding additional fees such as e-ticket or shipping fees, which will not be refunded) by the Organizer. This refund will only be made to the initial purchaser within 30 days following their refund request. In case of event cancellation, unless otherwise stipulated, the Organizer agrees to refund the Clients the ticket price. Under no circumstances can France Billet be held liable in case of a failure in ticket refunds by the Organizer, nor in case of changes in the time, place, distribution (artists or actors participating in the performance), or more broadly, the event holding conditions that fall under the Organizer's prerogatives. France Billet is not obliged to refund, however, it will do everything in its power to facilitate communication between the Organizer and its Client within the limits conferred by its mandate and enable the Client to obtain a refund. In all cases, no fees of any kind will be refunded or compensated. A ticket cannot be resold at a price higher than the one stated on the front of said ticket. No duplicate of the ticket will be issued, even in case of loss or theft. During the control at the entrance of the event venue, a valid photo ID may be requested, and it must correspond to the name on the ticket if it is nominative. Any refund request expressed after the rescheduled event date will not be processed. Events take place under the sole responsibility of the Organizer. France Billet cannot, under any circumstances, be held responsible. Upon the announcement of the cancellation or modification of the date, time, or venue of a show for which you have reserved seats, the Organizer will, as far as possible, use the contact details you provided during the reservation to inform you of the steps to follow. We invite you to check 24 hours before your show that it is maintained without modification by visiting the Organizer's website. ARTICLE 10 - CUSTOMER SERVICE AND ORDER TRACKING For any information or questions regarding the Event, the Organizer's Customer Service is at your disposal at the contact details provided by the Organizer. France Billet will make its best efforts to forward your request if necessary. For any assistance requests concerning the Eventim Light Service, France Billet's Customer Service is at your disposal: serviceclients@eventim-light.fr ARTICLE 11 - APPLICABLE LAW - DISPUTES Applicable law: Ticket sales covered by these terms are subject to French law. The language of this contract is French. In case of a dispute, only French courts have jurisdiction. Responsibility of the Organizer: Events take place under the sole responsibility of the Organizer, who assumes responsibility for the event's cancellation, modification, or postponement and the possible refund of the ticket price to the Client. Responsibility of France Billet: In accordance with Article L 121-20-3 of the Consumer Code, France Billet is fully responsible to the consumer for the proper execution of the matchmaking service, consisting of executing the payment and transmitting the ticket. Clients have the option to use consumer mediation in case of a dispute with an Organizer or the Intermediary.
